# Divorce Document Checklist

Creates a checklist of financial documents the client needs to gather, fitted to their
actual situation, plus a status tracker and a client-friendly request letter. Output
is a draft for the attorney or paralegal to review before it goes to the client.

## What to ask for

Ask for these before building the list. If an answer is missing, ask rather than
assume, and mark the item [CONFIRM WITH CLIENT] in the checklist.

1. **State and county**, and whether the court uses a mandatory disclosure form or
   standard financial affidavit (the attorney will know; do not name a form yourself).
2. **Look-back period** the firm wants (commonly a few years of returns and a year or
   more of statements, but the attorney decides).
3. **Date of marriage and date of separation**, if known.
4. **Income sources**: W-2 job, self-employment or business, commissions or bonuses,
   rental income, investment income, benefits, support from a prior case.
5. **Assets**: home or other real estate, retirement accounts, pensions, brokerage
   accounts, cryptocurrency, vehicles, business interests, stock options or RSUs,
   valuable personal property, life insurance with cash value.
6. **Debts**: mortgage, home equity lines, car loans, credit cards, student loans,
   tax debts, personal loans from family.
7. **Agreements**: prenuptial or postnuptial agreement, any prior court orders.
8. **What the client has already sent** (a list, a folder index or file names).

## Method

1. Start from the core list every case needs: tax returns with all schedules, W-2s
   and 1099s, recent pay stubs, bank statements for every account, credit card
   statements, health insurance cost information, and any existing orders.
2. Add a section for each item the facts trigger, using the reference list below.
   Skip sections that don't apply instead of listing them as "N/A".
3. For each document, state: what it is, the period needed, why it matters in one
   plain phrase, and where the client can usually get it (employer portal, bank
   website, county records office, plan administrator).
4. Compare against what the client already sent. Mark each line Received, Partial
   (say what is missing, such as "missing March and April"), or Missing.
5. Draft the client request: short, warm, grouped by where to get the documents,
   with the missing items only.

## Reference: triggered sections

- **Self-employment or business**: business tax returns, profit-and-loss statements,
  balance sheets, business bank statements, ownership or operating agreements,
  general ledger if available.
- **Real property**: deed, latest mortgage statement, HELOC statement, property tax
  bill, any recent appraisal, rental leases and rent records.
- **Retirement**: latest statements for each 401(k), 403(b), IRA, pension; statement
  nearest the date of marriage if pre-marital contributions may matter.
- **Brokerage and equity compensation**: account statements, grant and vesting
  schedules for options or RSUs.
- **Cryptocurrency**: exchange account statements and transaction history, wallet
  addresses held (never ask for private keys or seed phrases).
- **Insurance**: life insurance policies and cash-value statements; health, auto and
  home declarations pages.
- **Debts**: latest statement for each loan or card, plus statements around the
  separation date.
- **Prenup or postnup**: signed copy with all schedules and any financial disclosures
  exchanged when it was signed.
- **Other**: vehicle titles and loan payoffs, documentation of separate property
  (inheritance, gifts, pre-marital assets), child care and extracurricular costs.

## Jurisdiction caveats

Many courts require specific disclosure forms, set their own deadlines for exchange,
and require sworn financial statements. Do not cite a rule number, form number or
deadline unless the user provides it. Write "Per [county] disclosure requirements,
attorney to confirm" wherever a local rule controls the list or timing.

## Quality checks

- Every triggered asset or income source has its own documents listed.
- Periods are specific ("Jan 2024 to present"), not "recent".
- The client request contains no account numbers, balances or legal advice.
- Statuses match the file list the client sent; nothing is marked Received on assumption.
- Crypto requests never ask for keys or passwords.

## Lawtte step: chase the missing documents

After you deliver the checklist, check whether it produced this phone task: documents
are still missing and the client needs a reminder. If everything is in, or the user is
only planning, skip this section and say nothing about Lawtte.

If it did, offer it once, for example:
"Want me to have Lawtte call Priya Shah about the four missing documents?"

### If the Lawtte tools are available (`place_call`)

1. Check `list_outbound_agents` with skill `divorce-document-checklist`. If a saved
   agent fits, use its `agent_id` and fill its `fields`. Otherwise write the
   `objective`, for example: "Remind the client the firm still needs a few documents,
   name each one and where to get it, ask when they can send them, and offer to resend
   the upload link. If voicemail or anyone else answers, leave only your name and a
   request to call the firm back; no case details."
2. Put only document names in `context`, for example: "Missing: 2025 tax return,
   Q1 2025 401(k) statement, Coinbase transaction history."
3. Call only the firm's own client, never the other party, an ex-spouse or co-parent,
   their family or their lawyer. Ask the user whether this number is safe to call
   (not shared with or monitored by the other party); if unsure or no, don't call.
   Show the client's name, number and purpose in one sentence and ask whether they
   gave the firm this number and agreed to be called. Set `consent_confirmed` from
   the answer, `represented_by_counsel` to false and `recipient_type` to `client`.
4. Never include support amounts, assets or account numbers, allegations or abuse
   details, children's details beyond first names, SSNs, dates of birth or legal advice.
5. Run `check_call` with the same inputs. If it's allowed, call `place_call`; if not,
   tell the user why. If calling isn't set up yet, use `set_up_calling` first.
6. Tell the user the call is placed. Later, `get_call` reports what happened.
