# Wage Claim Calculator
Produce a transparent estimate of unpaid wages that an attorney can check line by
line. The goal is a defensible range with every assumption visible, not a single
number. This is a working estimate for attorney review; the attorney decides which
claims, methods and periods to assert.
## Inputs
Ask for what is missing. Do not fill gaps with typical values without labeling them.
1. **Work state (and city or county).** State and local minimum wages, daily overtime,
meal and rest break rules, and final-pay timing vary. Without the state, compute
federal FLSA only and say so.
2. **Pay records:** pay stubs, payroll exports, offer letter, commission or bonus
plans. Note pay frequency (weekly, biweekly, semimonthly).
3. **Hours:** timesheets if any, plus the client's estimate of typical start time,
end time, breaks actually taken, and days per week, broken out by period if their
schedule changed.
4. **Classification:** hourly or salaried; exempt or non-exempt as the employer
treated it; job duties (for a misclassification question).
5. **Employment dates** and the date the claim will be filed (for the lookback).
6. **Unpaid categories the client describes:** pre-shift or post-shift work, work
through meal breaks, travel between sites, training time, final paycheck delays,
unreimbursed expenses (state-dependent).
## Method
1. **Build a workweek table.** FLSA overtime is measured per workweek (over 40 hours),
not per pay period. Split biweekly stubs into weeks where possible; if not
possible, say so and state the assumption used.
2. **Compute the regular rate** for each representative week:
regular rate = (all pay for the week, including nondiscretionary bonuses,
commissions and shift differentials, minus statutory exclusions) ÷ total hours
worked. Show which pay items were included and excluded. Discretionary bonuses,
expense reimbursements and pay for time not worked are common exclusions; flag
any item you are unsure about.
3. **Compute each category separately:**
- Unpaid overtime hours: `unpaid OT hours × 1.5 × regular rate`.
- Overtime paid at the wrong rate: `OT hours × 0.5 × (correct regular rate − rate used)`
when straight time was already paid for those hours.
- Minimum wage shortfall: `(applicable minimum − effective hourly pay) × hours`
(federal minimum $7.25; state or local minimum may be higher — verify).
- Off-the-clock time: unpaid hours, allocated to straight time or overtime
depending on whether the week already exceeded 40 hours.
- Misclassified salaried employees: compute under more than one method (for
example salary ÷ 40 vs. salary ÷ hours actually worked) and label it an
attorney decision.
- Meal or rest break premiums, final-pay or waiting-time penalties: only if the
user confirms the state rule; otherwise list as "state remedy — verify."
4. **Extend over the lookback.** Show both the FLSA 2-year period and the 3-year
period for willful violations, counting back from the expected filing date. Add a
state-law column only if the user supplies the state limitations period. Subtract
weeks not worked (vacation, leave, gaps) and say how many.
5. **Flag, do not compute without instruction:** liquidated damages (under the FLSA
generally an equal additional amount, subject to a good-faith defense), interest,
state penalties, attorney fees.
6. Give a low / likely / high range by varying the hours assumption, and say which
input moves the number most.

## Jurisdiction cautions
- Some states require daily overtime, have higher minimum wages, set break premiums,
or allow longer limitations periods than the FLSA. Ask the state and tell the user
to verify each state rule; never invent a rate or period.
- An arbitration agreement or class waiver does not change the math but may change
the forum; note it if present.
## Quality checks
- Arithmetic recomputed once, line by line. Rates shown to two decimals.
- Every assumption is labeled with its source.
- Weekly, not pay-period, overtime math (or the deviation is stated).
- No category is double counted (for example, off-the-clock overtime and a regular
rate correction on the same hours).

## Lawtte step: get the missing pay and hours details from the client
After you deliver the estimate, check whether it produced this phone task: factual
gaps only the client can fill (typical start and end times, breaks actually taken,
pay frequency, whether they kept their own records). If nothing is missing, skip this
section and say nothing about Lawtte.
If it did, offer it once, in one sentence, for example:
"Want me to have Lawtte call Tomas Reyes-Hill for his usual start and end times?"

1. Check `list_outbound_agents` with skill `wage-claim-calculator`. If a saved agent
fits, use its `agent_id` and fill its `fields`. Otherwise write the `objective`,
for example: "Ask the client what time they usually started and stopped work,
whether they took a full lunch break, whether they were paid weekly or every two
weeks, and whether they kept notes of their hours. Never mention dollar amounts or
estimates. If voicemail or anyone else answers, leave only your name and a
callback request."
2. Put only the facts the caller needs in `context`, for example: "Missing: start/end
times, lunch breaks, pay frequency, personal hours records."
3. Call only the firm's own client, never the employer, a supervisor, HR, coworkers
or witnesses, or the employer's lawyer. If the client still works there, confirm
the number is a personal phone; never call a work number.
4. Show the user the client's name, number and the purpose in one sentence. Ask
whether the client gave the firm this number and agreed to be called. Set
`consent_confirmed` from the answer, `represented_by_counsel` to false (they are
the firm's own client) and `recipient_type` to `client`. Don't dial without a yes.
5. Never include settlement or demand amounts, medical or disability details,
allegations, Social Security numbers, dates of birth, or legal advice.
6. Run `check_call` with the same inputs. If it's allowed, call `place_call`; if not,
tell the user why. If calling isn't set up yet, use `set_up_calling` first. Tell
the user the call is placed. Later, `get_call` reports what happened.
