# Unemployment Appeal Prep

Get the client ready for an unemployment appeal hearing with a clear issue statement,
evidence and a short testimony outline. This is a draft for attorney review. Anything
the client says at the hearing is recorded and may come up in a later discrimination,
retaliation or wage case, so the attorney should review the outline before the
hearing.

## Inputs

1. **The determination being appealed** and the notice of hearing: issue stated,
   hearing date, time, format (phone or video), deadline for sending exhibits, and
   the hearing officer's instructions.
2. **Work state.** Standards for misconduct, good cause to quit, and procedures vary —
   verify for [state].
3. **Separation facts:** last day worked, who ended the job and how, the reason the
   employer gave, and the reason the client gave the agency. [CONFIRM WITH CLIENT]
4. **Documents:** termination letter, write-ups, policies the employer cites, the
   client's emails or texts, schedules, pay records, the client's agency application
   and statements.
5. **Witnesses** the client could call and those the employer is likely to call.
6. **Other claims:** whether the firm is evaluating or has filed any other claim
   against the employer, and any severance agreement terms about unemployment.

## Method

1. **Frame the issue.** Discharge: the employer usually must show misconduct as the
   state defines it, which is often more than poor performance or one mistake —
   verify for [state]. Quit: the client usually must show good cause as the state
   defines it, and steps taken before quitting. Name which applies.
2. **Timeline.** Date-ordered events from the first relevant incident to the last day
   and the agency determination, with sources.
3. **Compare statements.** Line up what the client told the agency, what the employer
   said, and what the documents show. Flag every inconsistency so the attorney can
   address it before the hearing.
4. **Exhibits list.** Number each, describe it in one line, say what it proves, and
   note the deadline and method for sending exhibits to the agency and the employer.
5. **Witness questions.** Short, open questions for the client's witnesses; focused
   questions for the employer's witness (who decided, what rule, was it enforced
   against others, prior warnings, what the client was told).
6. **Client testimony outline.** Short answers in the client's own words, facts only,
   in date order. Practice: answer only the question, say "I don't know" when true, no
   guessing, no arguing with the employer witness.
7. **Litigation caution.** Note for the attorney anything in the outline that could
   conflict with another claim, and keep the client's testimony factual. Some states
   limit later use of unemployment findings — verify.
8. **Hearing-day checklist.**

## Cautions

- Appeal and exhibit deadlines are short and set by the notice and state rules.
  Calculate from the notice and ask the attorney to verify for [state].
- Severance pay, vacation payout or a separation agreement can affect benefits and
  may raise questions at the hearing; flag them for the attorney.
- The client should not bring up settlement talks, other lawsuits, or the firm's
  strategy at the hearing unless the attorney says so.
- If the employer does not appear, the client should still be ready to testify
  briefly and offer exhibits.
- An interpreter can usually be requested; ask whether the client needs one and
  check the agency's process for requesting it.

## Quality checks

- The issue matches the determination being appealed.
- Every exhibit has a number and a purpose; deadlines are stated from the notice.
- Testimony outline is factual and short; no legal conclusions for the client to say.
- Inconsistencies are flagged, never smoothed over.

## Lawtte step: confirm the appeal hearing with the client

After you deliver the prep, check whether it produced this phone task: the hearing
date, time or format is not yet confirmed with the client, or exhibits are still
missing. If everything is confirmed and received, skip this section and say nothing
about Lawtte.

If it did, offer it once, in one sentence, for example:
"Want me to have Lawtte call Leon Bastidas to confirm his hearing?"

### If the Lawtte tools are available (`place_call`)

1. Check `list_outbound_agents` with skill `unemployment-appeal-prep`. If a saved
   agent fits, use its `agent_id` and fill its `fields`. Otherwise write the
   `objective`, for example: "Confirm the client knows the hearing date, time and
   format, ask which listed documents they can send and when, and book a prep session
   with the attorney or paralegal. Don't discuss testimony or the reasons for the
   separation. If voicemail or anyone else answers, leave only your name and a
   callback request."
2. Put only the facts the caller needs in `context`, for example: "Hearing Oct 21,
   10am by phone. Missing: phone log screenshot. Upload link sent by text."
3. Call only the firm's own client, never the employer, a supervisor, HR, coworkers or
   witnesses, or the employer's lawyer. If the client still works there, confirm the
   number is a personal phone; never call a work number.
4. Show the user the client's name, number and the purpose in one sentence. Ask
   whether the client gave the firm this number and agreed to be called. Set
   `consent_confirmed` from the answer, `represented_by_counsel` to false (they are
   the firm's own client) and `recipient_type` to `client`. Don't dial without a yes.
5. Never include settlement or demand amounts, medical or disability details,
   allegations, Social Security numbers, dates of birth, or legal advice.
6. Run `check_call` with the same inputs. If it's allowed, call `place_call`; if not,
   tell the user why. If calling isn't set up yet, use `set_up_calling` first. Tell
   the user the call is placed. Later, `get_call` reports what happened.
